This guy was just on Coast to Coast AM.  It’s pretty explosive stuff, if it’s for real:

(Lafayette Hill, Pennsylvania - 08/21/08) - Philip J. Berg, Esquire, [Berg is a former Deputy Attorney General of Pennsylvania; former candidate for Governor and U.S. Senate in Democratic Primaries; former Chair of the Democratic Party in Montgomery County; former member of Democratic State Committee; an attorney with offices in Montgomery County, PA and an active practice in Philadelphia, PA, filed a lawsuit in Federal Court today, Berg vs. Obama, Civil Action No. 08-cv-4083, seeking a Declaratory Judgment and an Injunction that Obama does not meet the qualifications to be President of the United States. Berg filed this suit for the best interests of the Democratic Party and the citizens of the United States.
Philip J. Berg, Esquire stated in his lawsuit that Senator Obama:

1. Is not a naturalized citizen; and/or

2. Lost his citizenship when he was adopted in Indonesia; and/or

3. Has dual loyalties because of his citizenship with Kenya and Indonesia.

Berg stated: “I filed this action at this time to avoid the obvious problems that will occur when the Republican Party raises these issues after Obama is nominated.

If Obama can prove U.S. citizenship, we still have the issue of muti-citizenship with responsibilities owed to and allegance to other countries.

Keep in mind that this guy is a Democrat who personally supported Hillary Clinton for the nomination.  He claims that his motivation is that the Republicans have already discovered all of this and are going to use it sometime after the nomination to cause chaos within the Democrats.  Given Berg’s Party and legal qualifications, I think he deserves to be listened to.  Essentially, he says that if Obama will release the information he wants, he will withdraw the suit and if he does not, he should be withdrawn as the nominee because he is ineligible under the Constitution.

Here’s the information he wants:

There have been numerous questions raised about Obama’s background with no satisfactory answers. The questions that I have addressed include, but are not limited to:

1. Where was Obama born? Hawaii; an island off of Hawaii; Kenya; Canada; or ?

2. Was he a citizen of Kenya, Indonesia and/or Canada?

3. What was the early childhood of Obama in Hawaii; in Kenya; in Indonesia when he was adopted; and later, back to Hawaii?

4. An explanation as to the various names utilized by Obama that include: Barack Hussein Obama; Barry Soetoro; Barry Obama; Barack Dunham; and Barry Dunham.

5. Illinois Bar Application - Obama fails to acknowledge use of names other than Barack Hussein Obama, a blatant lie.

Some of his evidence includes:

A birth certificate for a “Barack Obama, Jr” filed in Mombasa, Kenya around the time Obama was born
When Obama travelled to Pakistan as a younger man, he used an Indonesian passport
Obama never affirmed his citizenship upon becoming an adult after being adopted by his foreign-born stepfather
Obama’s Hawaiian birth certificate is currently sealed and the one we have seen is a forgery; this has been confirmed by supposed “experts”

Is Obama a fraud?  I don’t know.  The press was only too happy to entertain questions about McCain’s citizenship after finding that he was born in the Panama Canal Zone.  As unqualified as Obama is for the office of the Presidency, it wouldn’t surprise me to find out that he isn’t even Constitutionally eligible to be President.  This Berg guy appears to be legitimate and he is only asking for clarification. The smart thing for Obama to do would be to release this information, since I’m giving him the benefit of the doubt that he would not be so incredibly stupid to run for President and win the nomination if the Republicans could simply prove that he is not legally able to assume the office.

Frankly, I do not believe that we need to do this to beat Obama in November, but it would be appropriate for these questions to be answered.  It’s actually a shame that it had to come to a lawsuit to make this happen.  I will keep an eye on this story and see if it has any legs, even if I don’t personally think much will come of it.

Update: Of all places I could have found, the DailyKos actually has some good information on this matter:

Berg claims—and what he’s claiming here might well have been true at some earlier time, what I don’t know is what the rules were c. 1967—that when Obama’s mother married the Indonesian and went to live with him in Indonesia, under then-prevailing law, she (and, by extension Obama) lost their United States citizenship.

According to Berg, such loss of citizenship was not irrevocable, but required Obama’s mother to affirmatively regain her US citizenship, by taking an “Oath of Allegiance” before a consular or other official named in the statute.  Berg claims there is no indication that she ever did this.

According to Berg, assuming Mom did not take the Oath of Allegiance during Obama’s minority, it was incumbent upon Obama himself, after he reached the age of 18, to do so on his own.  That, Berg asserts, Obama did not do.

While, again, I have not researched this, the issue should be reasonably straightforward, at least for a good immigration and nationality lawyer.

Did the law in the late 1960s result in Obama’s mother (and Obama) losing their US citizenship, upon her marriage to an Indonesian and relocating with him, and with Obama, to Indonesia?

I would be somewhat surprised if that, in fact, was the state of the law as late as the late 1960s, but as they say, “it is what is is” (or it was what it was).

If Berg’s wrong on this legal point, and Obama can prove his birth in Hawaii, even assuming Berg is not thrown out on his ear for lack of standing, because Obama has more money than Berg has (as Denny Crane would argue is the basis of most court decisions) or whatever, Berg loses on the merits.

If Berg is CORRECT on this legal point, then Obama might have to show that he, or his mother, took the Oath of Allegiance.  As those things are recorded and the records kept at the consulate, etc., it ought to be pretty easy for Obama to do.  But if he did not, then maybe he has a problem.

Notably, Il Pugnale di Chicolini, the author of this Kos entry, agrees that Obama’s citizenship issues should be resolved as soon as possible.

UPDATE 2: Refer below to dwex’s comment.  He literally lays down the law and shows exactly why this thing is going nowhere—even if Berg’s allegations are true about Obama’s Kenyan birth.
