While dwex’s state is working to prevent the rise of The Beast, Kansas has been drafting some decent pro-freedom/pro-business legislation that will also raise revenue:

Legislation in Kansas would replace local public smoking bans with a weaker statewide prohibition that would allow bars and restaurants to opt out by paying a fee.

The bill, HB 2642, would permit bars and restaurants to allow smoking in separately ventilated areas of their businesses — if they agree to pay the state $1 for each square foot of smoking section. Establishments could also allow smoking throughout their businesses, but minors would not be allowed to enter.

I’m not sure if it will pass or not.  Their (Democrat) governor will probably veto it.  Smoking definitely isn’t a good thing, but I like compromises such as this that uphold the rights of the business owner and allow the customers to make their own choices.  If any bar or restaurant thinks it’s good enough for business to pay the additional tax, they should be allowed to.

Last October, I took a class here in KC, Missouri (which has a citywide ban on smoking in bars and restaurants) and walked over to a little neighborhood tavern to wait for Mrs Thrill to pick me up.  When I walked in, everybody—employees, customers—gave me a suspicious look until I sat down and ordered a beer.  A few minutes later, the bartender dropped ashtrays down on the bar and every man and woman in the damn place lit up cigarettes.

I asked the bartender if we were within Kansas City city limits and he laughed and said that they always smoke in there but they had held off on smoking because they “didn’t know who I was.”  I drank some beer so I couldn’t have been from the Morality Squad, I guess.

Still, it was that guy’s fucking bar and he and his grownup customers had to pretend like they were teenagers smoking in their bedrooms.  I cannot think of a better imagery for the nanny-state.  Good on Kansas for trying to undo anti-freedom laws and fuck the governor if he vetoes it.
